Notice and Personal Information Collection Agreement
注意事項 Terms and Conditions
1.作品需為2024年度之原創，不得有剽竊、臨摹、盜用、挪用抄襲或轉載他人作品參加之情事。
The work must be an original creation during the year of 2024 and must not involve plagiarism, imitation, unauthorized use, appropriation, or submission of someone else’s work.
2.作品不得涉及暴力、色情、誹謗，或有違反法律、公共秩序、善良風俗之虞。
The work must not contain violence, pornography, defamation, or anything that violates the law, public order, or good morals.
3.作品整體或部分內容之相關影音、文字等資料，均無侵害他人著作權等智慧財產權。作品若有違法或致侵害歌劇院權利情事，應由創作者負責承擔。當創作者及作品若有不符規定、資料不齊全者或無法讀取等情形，歌劇院有權取消或刪除其資格。
The overall or partial content of the work, including but not limited to audio-visual and textual materials, must not infringe upon the intellectual property rights of any third party. The creator warrants the work doesn’t violate any laws, and hold harmless NTT against any third party claim or action brought against NTT, the creator shall pay all costs, attorneys’ fees and damages finally awarded or agreed by NTT in settlement of such claims. NTT may disqualify the creator from this project in the event of the creator does not comply with the Terms and Conditions, provide incomplete data, or the work is unreadable or unqualified.
4.第2、3階段入選者，歌劇院將以E-mail寄發入選通知及資料，入選者請於E-mail所載日期前回覆確認，第3階段須另回傳完成簽署之創作及授權同意書，逾期或未提供完整資料視同放棄入選資格；未入選者不另行通知。
Selected creators of Phases 2 and 3 will be informed the selection results by NTT via email. The creators must reply and confirm your participation pursuant to the date specified in the notification of selection email. The creator selected in Phase 3 must also return a signed copy of the Artwork Copyright License Agreement. Failure to meet deadlines or provide complete information required will be considered as a waiver of such selection. Unselected creators will not be individually notified.
5.第3階段入選者同意授權歌劇院為執行藝文推廣等目的，得無償使用為本計畫創作之影片於歌劇院自有或有權使用之平面或電子媒體、宣傳品，得為包括重製、改作、公開播放、廣宣等行為，且無使用次數限制，因此產出內容之權利歸歌劇院享有。授權期間自2025年1月1日起至2029年12月31日止。
Selected creators of Phase 3 agree to authorize NTT to utilize the created works for the project with no additional charge for the purpose of arts and culture promotion, including but not limited to reproduction, adaptation, public broadcast, and promotion on print or digital media, as well as other promotional materials owned or used by NTT, without limitation on the number of times. Any intellectual property rights arising from NTT utilized the created works will vest exclusively in NTT. The authorization period hereinbefore is commencing from January 1, 2025, to December 31, 2029.
6.第4階段展演票選得票數第1、2名作品，由歌劇院安排創作顧問協助作品發展為8分鐘最終完成作品。獲獎者須配合作品發展製作期程（2026年5月至12月期間；最終完成作品展覽期程將依歌劇院安排），無法配合者，同意歌劇院撤銷獲獎資格並返還獎金。
The first and second-ranked works in the final voting of phase 4 will be assisted to develop into a final 8-minute work by the creative consultants assigned from NTT. Award creators must adhere to the production developed schedule for the works, which will take place from May to December 2026. The exhibition period for the final works will be arranged by NTT. The creators agree to be withdrew the qualification and refund the monetary award under the occasion of unavailable or unable to cooperate such schedule.
7.入選作品不得在正式演出前於其他場合公開作品全部或部分內容，事前經歌劇院書面同意者除外。
Selected works must not be publicly displayed or disclosed in whole or in part before the exhibition officially commences without prior written consent from NTT.
8.以團隊名義參賽者，需詳列團隊人數以利相關作業，並附上代表人詳細資料，權利義務由代表人行使。
Team creators must provide a detailed list of team members to NTT for any administrative process required, as well as comprehensive information about the team representative. All rights and obligations of the work will be exercised by the team representative.
9.入選者應依申請表所提之計畫確實執行。藝術內容、規模結構、製作團隊、主創群或製作期程等如有任何變更，至遲應於各階段前1個月提出，歌劇院保有同意或撤銷入選資格之權利。
Selected creators must execute the project as proposed. Any changes to the artistic content, scale, structure, production team, core creative team, or production schedule must be submitted at least one month prior to each phase. NTT has the right to approve or withdraw the selected qualification.
10.製作進度嚴重落後或內容與原計畫落差過大，歌劇院有權取消該作品展演資格，入選者需返還歌劇院已支付相關之製作經費。
If the production significantly has fallen behind schedule or diverged substantially from the original proposal, NTT has the right to withdraw the qualification for exhibition, and the creators must return any production funding granted by NTT for the Project.
11.入選者須配合歌劇院各階段之行銷宣傳安排。
Selected creators must cooperate with NTT’s marketing and promotional arrangements at each phase.
12.歌劇院基於辦理徵件及服務提供必要，依據個人資料保護法蒐集申請者之個人資料，包含姓名、出生日期、身分證統一編號、通訊地址、E-MAIL、電話等，以作為確認、憑證及歌劇院訊息通知使用；如有依個人資料保護法請求查閱、製給複製本、補充或更正資料、請求停止蒐集、處理利用或刪除之必要，請聯繫承辦人員。申請者得自由選擇是否提供相關個人資料，惟若選擇不提供相關個人資料或提供不完整時，將無法判斷申請者個人資料正確性及即時通知徵件相關訊息。
For the Project’s administrative needs, NTT collects personal information from creators, including but not limited to full-name, date of birth, ID number, address, email, phone number, for confirmation, certification, and communication purposes in accordance with the Personal Data Protection Act. If there is a need to request access to, copies of, supplementation, correction, cessation of collection, processing, utilization, or deletion of personal information in accordance with the Personal Data Protection Act, please contact the project coordinator. All creators are in decision to decide whether providing personal information; however, NTT may not be able to verify the accuracy of personal information or to promptly notify the creator of any update due to the lack of complete personal information required.
13.依「公職人員利益迴避衝突法」規定，團隊成員（含董監事、負責人、藝術總監、團長、主要經理人等）與國家表演藝術中心及轄下三館一團之相關業務承辦、經辦、監辦、採購人員及相關主管、藝術總監是否有下列情形者，應自行迴避：
In accordance with the Act on Recusal of Public Servants Due to Conflicts of Interest, team members—including directors, responsible persons, artistic directors, group leaders, key managers, etc.—must recuse themselves with the following relationships to business coordinators, handlers, supervisors, purchasers and relevant managers, or artistic directors of the National Performing Arts Center including National Theater and Concert Hall, NTT, National Kaohsiung Theater and Concert Hall , and National Symphony Orchestra:
(1)同一人。Same person.
(2)具有配偶之親屬關係者。Individuals with a spousal relationship.
(3)具有三親等以內之親屬關係者。Individuals with a blood relationship within three degrees.
14.歌劇院保留本計畫甄選辦法異動之權利與最終解釋權。
Any final interpretation and modification to the Project shall be made by NTT.
個人資料蒐集告知及聲明書 Personal Information Collection Notice and Agreement
歌劇院為保護您的個人資料，依據個人資料保護法規定，於下列事由與目的範圍內，說明歌劇院直接或間接蒐集、處理及利用您的個人資料，當您完成報名時，表示您同意以下內容：
To protect your personal data, NTT collects, processes, and utilizes your personal information directly or indirectly in accordance with the Personal Data Protection Act. By completing the application form, you agree to the following:
1.蒐集之目的：基於個人資料保護法及相關法令之規定，取得您的個人資料，目的在於提供良好服務及執行職務或業務之必要範圍內蒐集、處理及利用您的個人資料。您同意歌劇院以您所提供的個人資料確認您的身份、與您進行連絡、提供您本計畫之相關服務及資訊，包括後續通知等用途。
Purpose of Collection: NTT collects, processes, and utilizes your personal data within the necessary scope to provide quality services and fulfill its duties or business operations in compliance with Personal Information Protection Act and relevant laws and regulations. You consent to NTT using the personal information you provided to verify your identity, communicate with you, provide relevant services and information related to this Project, and for subsequent notifications.
2.個人資料之類別：依據徵件需求提供您的個人資料，包含姓名、身份證字號、出生日期、電話、E-MAIL等。
Categories of Personal Data: Based on the application requirements, your personal data may include your name, ID number, date of birth, phone number, email address, and other relevant information.
3.您同意於本計畫執行中利用您個人資料的期間、地區、對象及方式：
You agree to the use of your personal data during the execution of the project, including the region, recipients, and methods of use as outlined below:
(1) 地區：中華民國領域 Region: Territory of the Republic of China.
(2) 對象：本場館同仁相關作業人員 Recipients: Relevant staff members of NTT.
(3) 方式：以電話、電子郵件或其他合於當時科技之適當方式作個人資料之利用 Method: Use of personal data via phone, email, or other appropriate means in line with current technology.
4.您的個人資料蒐集之目的消失或期限屆滿時，您同意本計畫得繼續保存、處理或利用您的個人資料。除歌劇院於計畫執行期間因執行職務或業務所必須或為遵循其他法令之規定者外，您可於計畫期間隨時向歌劇院請求刪除、停止處理或利用您的個人資料。
When the purpose of collecting your personal data has been fulfilled or the retention period has expired, you agree that the project may continue to retain, process, or use your personal data. However, except when necessary for the performance of duties or business operations during the project execution, or when required to comply with other legal regulations, you may request NTT at any time during the project period to erase, cease processing, or cease using your personal data.
5.您得自由選擇是否提供相關個人資料予本案蒐集、處理及利用，惟您若選擇不提供，或只提供部份/不完全/不真實/不正確個人資料予本計畫，或提供後向歌劇院請求刪除部分或全部個人資料，或您所提供的個人資料，經檢舉或發現不足以確認您的身分真實性或其他個人資料冒用、盜用等情形時，導致歌劇院無法進行必要之審核及處理，歌劇院有權暫時停止提供對您的服務，若有不便之處尚請見諒。
You are in decision to choose whether to provide the relevant personal data for collection, processing, and use for the project. However, if you choose not to provide it, provide only partial, incomplete, false, or incorrect personal data, request NTT to erase some or all of your personal data after providing it, or if the personal data you provide is reported or found to be insufficient to verify your identity or is involved in impersonation or unauthorized use, resulting in NTT being unable to conduct the necessary review and processing, NTT has the right to temporarily suspend the services provided to you. We apologize for any inconvenience this may cause.
6.您已清楚瞭解此一同意符合個人資料保護法及相關法規之要求，具有書面同意歌劇院蒐集、處理及利用您的個人資料之效果。
You fully acknowledge and understand that this consent complies with the requirements of the Personal Data Protection Act and related regulations, and serves as your written consent for NTT to collect, process, and use your personal data.
